Waiver of Liability

I, the participant or parent/guardian of a participant, voluntarily choose to participate in activities offered by MSA, including but not limited to facility memberships, camps, clinics, training sessions, and other events.

Assumption of Risk:

I understand and acknowledge that participation in sports and physical activities carries inherent risks, including but not limited to personal injury, illness, or property damage. I voluntarily assume all risks associated with participation.

Release of Liability:

I release, discharge, and hold harmless MSA, its officers, directors, employees, coaches, volunteers, agents, and affiliates from any and all claims, demands, damages, and liabilities arising out of or in connection with participation in any MSA activity, including but not limited to injuries, illnesses (including communicable diseases such as COVID-19), or accidents, whether caused by negligence or otherwise.

Health Insurance:

I certify that I (or my child, if signing as a parent/guardian) carry my own health insurance and accept full responsibility for any medical expenses incurred as a result of participation.

Emergency Medical Treatment:

In the event of an injury or medical emergency, I authorize MSA staff or agents to provide or seek medical treatment on my behalf (or my child’s behalf) and agree to assume all financial responsibility for such treatment.

Property Damage:

I understand that I am responsible for any damage to MSA property or equipment caused by myself or my child and agree to reimburse MSA for repair or replacement costs.

Photo/Video Release:

I grant permission for MSA to use photographs, videos, or other media of myself or my child taken during activities for promotional or educational purposes without compensation.

Compliance with Policies:

I agree to comply with all MSA policies, rules, and procedures, including but not limited to safety guidelines, facility rules, and the concussion protocol.

Concussion Protocol

Acknowledgment of Concussion Protocol:

I confirm that I have read, reviewed, and understood the MSA Concussion Protocol, which can be found at: www.morsinksoccer.com/concussionprotocol . I agree to follow all recommendations outlined therein and acknowledge that the participant will not return to play without written clearance from a licensed healthcare provider if a concussion is suspected.

Indemnification

I agree to indemnify and hold harmless MSA from any claims, damages, or expenses (including legal fees) arising from my (or my child’s) participation in MSA activities, including claims brought by third parties.

Governing Law

This Agreement shall be governed by the laws of the state in which MSA operates. Any disputes arising from this Agreement will be resolved exclusively in the courts of that jurisdiction.

Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment and Agreement

By submitting this form, I acknowledge that I have read, understood, and agreed to the terms of this Liability Waiver and Release Agreement. I understand that I am waiving certain legal rights, including the right to sue, and I do so voluntarily.

This Liability Waiver and Release Agreement must be completed prior to participation in any MSA activities. Failure to complete the waiver will result in ineligibility to participate.

Use of Likeness Waiver

By registering for this program, I, as parent/guardian, permit MSA to use my child's name, photograph, and likeness in perpetuity in connection with the advertising and promotion of MSA, including but not limited to use in any and all publications and materials, promotional literature, and the MSA website without payment or consideration made to Client. The attendee waives the right to review any photo or video or to obtain royalties from the photo or video.
